Terms of Service

Welcome to ShiftSave. These Terms of Service ("Terms") govern your access to and use of the platform operated by ShiftSave LLC ("ShiftSave," "we," "our") (the "Service"). By accessing or using the Service, you agree to these Terms.

If you do not agree, do not use the Service.

1. The Service

ShiftSave provides a real-time guest feedback system for restaurants. Guests may submit feedback via QR codes, and restaurant staff may view and act on that feedback through a private dashboard.

The Service is intended for operational use only and is not a public review platform.

2. Eligibility

  • You must be at least 18 years old and authorized to act on behalf of a restaurant to use the Service.
  • Accounts are created by invitation or approval only. Unauthorized access is prohibited.

3. Accounts & Access

  • You are responsible for maintaining the confidentiality of your login credentials.
  • Magic link login links are single-use and expire automatically.
  • You are responsible for all activity performed under your account. You must notify us immediately of any unauthorized access or security breach.

4. Acceptable Use

You agree not to:

  • Use the Service for unlawful or fraudulent purposes
  • Interfere with or disrupt the Service or its infrastructure
  • Attempt to access data belonging to other restaurants
  • Misuse SMS Alerts or enable them for non-operational purposes

We reserve the right to suspend or terminate access for violations of these Terms.

5. Guest Feedback Content

Restaurants are solely responsible for how they respond to guest feedback.

ShiftSave:

  • Does not verify the accuracy of guest submissions
  • Is not responsible for guest behavior or statements
  • Does not publish or promote guest feedback publicly

6. SMS Alerts

If enabled, ShiftSave may send operational SMS Alerts to a phone number designated by the restaurant for a staff member or manager responsible for responding to guest issues.

During setup in the ShiftSave dashboard, the restaurant administrator enters the recipient's phone number and must check a required consent checkbox confirming that the recipient has explicitly agreed to receive these operational SMS Alerts before SMS can be enabled.

SMS Alerts are:

  • Operational only (not marketing or promotional)
  • Sent only when high-severity guest feedback is received
  • Sent to phone numbers provided and managed by the restaurant in the dashboard
  • Dependent on guest activity and restaurant volume

Recipients may opt out at any time by replying STOP and may re-subscribe by replying START or YES. Reply HELP for help.

Standard message and data rates may apply.

Restaurants are responsible for ensuring that designated recipients have provided appropriate consent to receive SMS Alerts.

7. Data & Privacy

Your use of the Service is subject to our Privacy Policy and SMS Policy.

ShiftSave does not sell personal data.

8. Service Availability

The Service is provided on an "as-is" and "as-available" basis.

We do not guarantee uninterrupted or error-free operation and may modify or discontinue features at any time.

9. Limitation of Liability

To the fullest extent permitted by law:

  • ShiftSave is not liable for indirect, incidental, or consequential damages
  • We are not responsible for lost revenue, reputational harm, or guest disputes
  • Total liability shall not exceed the amount paid to ShiftSave in the previous 12 months

10. Termination

We may suspend or terminate access:

  • For violation of these Terms
  • For misuse of the Service
  • To comply with legal obligations

You may stop using the Service at any time.

11. Changes to These Terms

We may update these Terms periodically. Continued use of the Service after changes constitutes acceptance.
